DEVELOPMENT ALLOWANCE AUTHORITY ACT 1992 No. 99 of 1992 - SECT 40

Criteria for granting application
40. The DAA must grant the application if the DAA is satisfied that:

   (a)  no part of the expenditure fails the basic eligibility test; and

   (b)  a substantial commitment to the completion of the project has occurred
        before 1 July 1996; and

   (c)  in a case where no substantial commitment to the completion of the
        project has occurred before 1 January 1993 - it is reasonably likely
        that the expenditure will pass the competitiveness test; and

   (d)  either:

        (i)    the expenditure has passed the $50 million threshold test; or

        (ii)   it is reasonably likely that the expenditure will pass the $50
               million threshold test.
