DEFENCE FORCE (PAPUA NEW GUINEA) RETIREMENT BENEFITS ACT 1973 No. 86 of 1973 - SECT 32
Commencement and cessation of contributions.
PART IV-CONTRIBUTIONS
Division 1-Contributions by Members
32. (1) Except as otherwise provided by this Act-
(a) a person who becomes a member on or after the date of commencement of
this Act shall contribute to the Fund from the date upon which he
becomes a member; and
(b) a person who was a member immediately before the date of commencement
of this Act shall contribute to the Fund from that date.
(2) Notwithstanding sub-section (1), where a member would, but for this
sub-section, be required to contribute to the Fund from a date that is not a
pay-day, that member shall contribute to the Fund from the pay-day next
succeeding that date.
(3) An enlisted member shall not contribute to the Fund unless he is serving,
or has served, under an engagement or re-engagement for a period of one year
or longer.
(4) A person shall not contribute to the Fund in respect of any period after
the day on which-
(a) he ceases to be a member;
(b) a period of two years after he attains the retiring age for the rank
held by him expires; or
(c) he attains the age of sixty years, whichever first occurs, or, if that
day is not a pay-day, after the pay-day last preceding that day.
(5) A reference in this section to a period includes a reference to a period
wholly or partly occurring before the date of commencement of this Act.
(6) In determining, for the purposes of the application of Part VI, whether a
person who, having ceased to be a member, again becomes a member is required
by this section to contribute to the Fund-
(a) a reference in sub-section (3) to engagement or re-engagement does not
include a reference to engagement or re-engagement of the person
before he again became a member; and
(b) the reference in sub-section (4) to the day on which he ceases to be a
member is a reference to the day on which he ceases to be a member
after he again became a member.
