(1) A person must not, for a prohibited reason, or for reasons that include a
prohibited reason, do, or threaten to do, either of the following:
- (a)
- discriminate against a contractor in relation to the terms and conditions of
the contract for services that the person has entered into with the
contractor;
- (b)
- terminate the contract for services.
(2) Conduct mentioned in subsection (1) is for a prohibited reason if it
is engaged in because the contractor, or an officer or employee of the
contractor:
- (a)
- may volunteer to render defence service; or
- (b)
- is rendering defence service; or
- (c)
- is, or may become, liable to render defence service; or
- (d)
- has previously rendered defence service.
(3) A person who contravenes subsection (1) is guilty of an offence.
Maximum penalty: 30 penalty units.
