DEFENCE RESERVE SERVICE (PROTECTION) ACT 2001 - SECT 23

Terminating etc. contract for services

(1) A person must not, for a prohibited reason, or for reasons that include a prohibited reason, do, or threaten to do, either of the following:

(a)
discriminate against a contractor in relation to the terms and conditions of the contract for services that the person has entered into with the contractor;

(b)
terminate the contract for services.

(2) Conduct mentioned in subsection (1) is for a prohibited reason if it is engaged in because the contractor, or an officer or employee of the contractor:

(a)
may volunteer to render defence service; or

(b)
is rendering defence service; or

(c)
is, or may become, liable to render defence service; or

(d)
has previously rendered defence service.

(3) A person who contravenes subsection (1) is guilty of an offence.

Maximum penalty: 30 penalty units.
