First Home Owners Act 1983 No. 46 of 1983 - SECT 38

Misleading statements, &c.

38. (1) A person shall not-

   (a)  in connection with, or in support of, an application for assistance;
        or

   (b)  with intent to deceive an officer, make, whether orally or in writing,
        a statement that, to his knowledge, is false or misleading in a
        material particular.

Penalty: $1,000 or imprisonment for 6 months, or both.

(2) A person shall not obtain payment of assistance by means of a statement
that, to his knowledge, is false or misleading in a material particular or by
means of impersonation or a fraudulent device.

Penalty: $2,000 or imprisonment for 12 months, or both.

(3) Where a person is convicted of an offence against this section, the court
may, in addition to imposing a penalty in respect of the offence, order him to
pay to the Commonwealth an amount equal to the amount of any assistance paid
in consequence of the act, failure or omission in respect of which he was
convicted.
