FISHING LEGISLATION AMENDMENT ACT 1987 No. 176 of 1987 - SECT 8

Offences in relation to notices under section 12
8. Section 16 of the Principal Act is amended by inserting after subsection
(1) the following subsections:

"(1A) A person who contravenes subsection (1) in circumstances in which the
person is not guilty of an offence under subsection (1B) is guilty of an
offence punishable, on conviction, by a fine not exceeding:

   (a)  if the person is a natural person-$5,000; or

   (b)  if the person is a body corporate-$25,000.

"(1B) A person who contravenes subsection (1) with the use of a foreign ship
is guilty of an offence punishable:

   (a)  on summary conviction-by a fine not exceeding:

        (i)    if the person is a natural person-$5,000; or

        (ii)   if the person is a body corporate-$25,000; and

   (b)  on conviction on indictment-by a fine not exceeding:

        (i)    if the person is a natural person-$50,000; or

        (ii)   if the person is a body corporate-$250,000.".
