FEDERAL MAGISTRATES (CONSEQUENTIAL AMENDMENTS) ACT 1999 NO. 194, 1999 - SCHEDULE 7

- Amendment of the Bankruptcy Act 1966

1 Subsection 5(1) (at the end of the definition of magistrate )

Add:

Note: A Federal Magistrate is not covered by this definition.

2 Subsection 5(1) (definition of Registrar )

Repeal the definition, substitute:

Registrar means:

(a)
the Registrar, a Deputy Registrar, a District Registrar or a Deputy District Registrar of the Federal Court; or

(b)
a Registrar of the Federal Magistrates Court.

3 At the end of section 5

Add:

(5)
To avoid doubt, a Federal Magistrate is taken to be a Judge of a Court having jurisdiction under this Act.

4 Section 27

Omit "has", substitute "and the Federal Magistrates Court have concurrent".

5 Subsection 30(3)

Before "Court" (wherever occurring), insert "Federal".

6 After subsection 35A(2)

Insert:

(2A)
If a proceeding is pending in the Federal Magistrates Court, the Federal Magistrates Court may, on the application of a party to the proceeding or on its own initiative, transfer the proceeding to the Family Court.

7 Subsection 35A(5)

After "Federal Court", insert "or the Federal Magistrates Court".
