Decisions for which the Secretary is responsible person
(1) Each of the following decisions of the Secretary is a reviewable decision and the Secretary is the responsible person for the decision:
(a) a decision under subsection 10(1) to trigger the minimum stockholding obligation for an entity in relation to an MSO product;
(b) a decision to specify a particular quantity of an MSO product in a notice under section 10 or 15;
(c) a decision under section 18 to refuse an application to temporarily reduce the quantity of stocks of an MSO product an entity must hold, or to grant the application by reducing the quantity by less than applied for;
(d) a decision under section 29 to refuse an application to suspend section 7 for an entity in relation to an MSO product;
(e) a decision under section 29 to suspend section 7 for a class of entities, or to suspend section 7 (whether for an entity or a class of entities) for a particular period;
(f) a decision under subsection 32(1) that the Secretary is not satisfied that an entity has permanently or indefinitely ceased undertaking all MSO activities in relation to an MSO product;
(g) a decision under subsection 36(2) to request an entity to ensure its plan deals with specified matters;
(h) a decision to make a determination under section 37 (determination of assumption or division of minimum stockholding obligation) or to refuse an application to make such a determination;
(i) a decision about the effect a determination under section 37 is to have on any notices in force under section 10, 15 or 18;
(j) a decision under section 52 to refuse an application to extend the period of cessation for the purposes of the repayment obligation in section 50.
Decisions for which the Minister is responsible person
(2) Each of the following decisions of the Minister is also a reviewable decision and the Minister is the responsible person for the decision:
(a) a decision under section 40 to refuse an application for fuel security services payment;
(b) a decision under section 40 about the duration of a person's commitment period;
(c) a decision under section 41 to refuse an application to vary or terminate a person's commitment period.
