(1) The Secretary may, in writing, appoint a person who is any of the following for the purposes of paragraphs 60(4)(b) and 61(3)(b):
(a) an APS employee in the Department;
(b) a person who is engaged as a consultant or contractor to perform services in relation to this Act;
(c) a member or special member of the Australian Federal Police.
Note: A person appointed under this section is an authorised person for the purposes of Parts 2 and 3 of the Regulatory Powers Act (monitoring and investigation), as those Parts apply in relation to this Act.
(2) The Secretary must not appoint a person unless the Secretary is satisfied that the person has the knowledge or experience necessary to properly exercise the powers of an authorised person under Parts 2 and 3 of the Regulatory Powers Act.
(3) A person appointed under subsection (1) must, in exercising powers under Parts 2 and 3 of the Regulatory Powers Act, as those Parts apply in relation to this Act, comply with any directions of the Secretary.
(4) If a direction is given under subsection (3) in writing, the direction is not a legislative instrument.
