HIGH COURT OF AUSTRALIA ACT 1979 No. 137 of 1979 - SECT 24

Termination of appointment
24. (1) The Governor-General may terminate the appointment of the Clerk by
reason of the misbehaviour or the physical or mental incapacity of the Clerk.

(2) If the Clerk-

   (a)  becomes bankrupt, applies to take the benefit of any law for the
        relief of bankrupt or insolvent debtors, compounds with his creditors
        or makes an assignment of his remuneration for their benefit;

   (b)  is absent from duty, except with the leave of the Court, for 14
        consecutive days or for 28 days in any 12 months; or

   (c)  without the approval of the Court, engages in paid employment outside
        the duties of his office, the Governor-General shall terminate the
        appointment of the Clerk.

(3) The powers of the Governor-General under sub-section (1) shall be
exercised only in accordance with advice that is consistent with
recommendations by the Court.
