HIGHER EDUCATION FUNDING AMENDMENT ACT (No. 2) 1992 No. 158 of 1992 - SECT 21

21. Section 26 of the Principal Act is amended:
(a) by omitting from subsection (3) "the State in which the institution is
situated" and substituting " the institution";

   (b)  by omitting subsection (4) and substituting the following subsection:
        "(4) If an amount has been determined under subsection (2) as the
        estimated maximum Commonwealth contribution towards a capital project
        of an institution, the total of:

   (a)  amounts payable to a State in relation to that capital project under
        this Act as in force before 1 January 1993; and

   (b)  amounts payable to the institution in relation to that capital project
        under this Act as in force on or after that day; must not exceed the
        estimated maximum Commonwealth contribution towards the project as
        determined, or last determined under subsection (2).";

   (c)  by omitting paragraphs (5)(e) and (f) and substituting the following
        paragraph:

"(e) in the case of the year 1993 - $255,041,000.";

   (d)  by omitting from subsection (6) "or to the State in which the
        institution is situated, as the case may be,". Note: section 26 of the
        Principal Act is subsequently repealed by section 50 of this Act.
