HEALTH INSURANCE AMENDMENT ACT (No. 2) 1978 No. 133 of 1978 - SECT 43
Claims for benefits with respect to period before 1 November 1978
43. (1) Where-
(a) an amount of medical benefit became payable under Part II of the
Health Insurance Act 1973 before the commencement of this section but
that amount had not been paid at the commencement of this section; and
(b) a claim for that amount is made after the commencement of this section
and before a date fixed by Proclamation for the purposes of this
section, payment of that claim shall be made out of the Health
Insurance Fund.
(2) Subject to section 8D of the Health Insurance Commission Act 1973, the
payment of claims referred to in sub-section (1) shall be made in such manner
as the Minister determines.
