HEALTH LEGISLATION AMENDMENT ACT 1986 No. 75 of 1986 - SECT 38

38. (1) Section 124G of the Principal Act is amended-
(a) by omitting from sub-section (1) "practitioner" and substituting

"person";

   (b)  by omitting sub-section (2) and substituting the following
        sub-section:

"(2) In accordance with guidelines (if any) in force under section 124H
relating to this sub-section, a Committee established in relation to a person
may, if it is satisfied, upon the evidence or other material available to it,
that no action should be taken against the person, determine that sub-section
(1) of this section does not apply in relation to the making of a
determination in relation to the person."; and

   (c)  by omitting from sub-section (3) "practitioner" and substituting
        "person".

(2) Notwithstanding the amendments made by sub-section (1), a determination
made under sub-section 124G (2) of the Principal Act and in force immediately
before the commencement of this section continues in force, after the
commencement of this section, as if the amendments had not been made.
