HEALTH LEGISLATION AMENDMENT ACT (No. 2) 1985 No. 167 of 1985 - SECT 71

Interpretation
71. Section 12 of the Principal Act is amended -

   (a)  by omitting sub-section (2) and substituting the following
subsection:

"(2) For the purposes of this Part, a person shall be taken to be a
specialist, or a consultant physician, in a particular specialty if, and only
if, the person is a medical practitioner who -

   (a)  is, for the purposes of the Health Insurance Act 1973, a
specialist, or a consultant physician, as the case may be, in
that specialty; or

   (b)  is employed as a specialist, or as a consultant physician, as
the case may be, in that specialty by -

        (i)    the Commonwealth, a State or an authority of the
Commonwealth or a State; or

        (ii)   the proprietors of a hospital."; and

   (b)  by omitting from sub-section (3) ", in relation to the State or
        Territory in which the professional service is to be, or has been,
        rendered".
