HEALTH LEGISLATION AMENDMENT ACT (No. 2) 1986 No. 94 of 1986 - SECT 38
Transitional
38. (1) Notwithstanding the amendments made by section 37, where, immediately
before the commencement of this sub-section, a person was, under the Principal
Act, an approved pharmaceutical chemist approved in respect of one or more
premises, that person shall be deemed, for the purposes of the
National Health Act 1953, to be an approved pharmacist in respect of those
premises.
(2) Notwithstanding the amendments made by sections 16, 31 and 33, the
Principal Act, as in force immediately before 1 January 1987, continues to
apply, on and after 1 January 1987, in relation to a prescribed journey that
commenced before 1 January 1987.
(3) In sub-section (2), "prescribed journey" means the journeys made in
connection with the rendering of a professional service to a patient, being
those journeys regarded as one journey.
(4) For the purposes of the continued application of the Principal Act in
accordance with sub-section (2) of this section, any approval or other
instrument that could, before 1 January 1987, have been given or made under
Part III of the Principal Act may be given or made on or after 1 January 1987.
