HEALTH LEGISLATION AMENDMENT ACT (No. 2) 1986 No. 94 of 1986 - SECT 41

41. After section 23D of the Principal Act the following section is inserted:
Notice of, and identification of, particular batches

"23DA. (1) The Secretary may, by notice in writing served on a manufacturing
corporation, require the corporation to give notice in writing to the
Secretary of each batch or other quantity of-

   (a)  a specified biological product;

   (b)  biological products of a specified kind; or

   (c)  all biological products, produced, or to be produced, in Australia by
        the corporation.

"(2) Where the Secretary has given a corporation notice under sub-section (1),
the corporation shall not supply in Australia a biological product to which
the notice relates to another person unless the corporation has given the
notice required by the first-mentioned notice.

"(3) A corporation shall not be taken to have complied with sub-section (2) in
relation to a batch or other quantity of a biological product unless the
notice given in relation to that batch or quantity includes such particulars
as will allow the Secretary to identify that batch or quantity.".
