(1) In spite of the repeal of the Australian Horticultural Corporation Act
1987 :
- (a)
- the Australian Dried Fruits Board continues in existence for the
purpose of giving the Minister the report required under section 9 of the
Commonwealth Authorities and Companies Act 1997 in relation to the period
starting on the last 1 July before the transfer day and ending on the
transfer day; and
- (b)
- for that purpose, the membership of the Board immediately before the
transfer day is taken to be the same on and after the transfer day.
(2) For the purposes of the application of section 9 of the
Commonwealth Authorities and Companies Act 1997 to the report referred to in
subsection (1):
- (a)
- the period starting on the last 1 July before
the transfer day and ending on the transfer day is taken to be a financial
year; and
- (b)
- the Australian Horticultural Corporation Act 1987 continues to have effect
as if it had not been repealed; and
- (c)
- the reference in paragraph 101A(b) of that Act to 31 August after the
end of the financial year is taken to be a reference to the day occurring 8
weeks after the transfer day; and
- (d)
- the reference in subsection 30A(1) of that Act to 15 October after
the end of each financial year is taken to be a reference to the day occurring
14 weeks after the transfer day.
