INDUSTRIAL RELATIONS REFORM ACT 1993 No. 98 of 1993 - SECT 14

14. Section 113 of the Principal Act is amended by inserting after subsection

(4) the following subsection:

"(4A) The Commission may refrain from hearing, further hearing, or
determining, as the case requires, an application for variation of an award
for so long as:

   (a)  it considers that, in all the circumstances, the parties concerned
        should try to negotiate an agreement under Part VIB to deal with the
        subject matter of the proposed variation; and

   (b)  it is not satisfied that there is no reasonable prospect of the
        parties making such an agreement.".
