INDUSTRIAL RELATIONS REFORM ACT 1993 No. 98 of 1993 - SECT 28

28. Section 122 of the Principal Act is amended by omitting subsection (3) and
substituting the following subsection:

"(3) If:

   (a)  the Commission has directed under subsection (1) that preference is to
        be given to members of an organisation of employees or to persons who
        have applied to become members of such an organisation; or

   (b)  a certified agreement or enterprise flexibility agreement provides for
        preference to be so given; an employer is not required, because of the
        award, order or agreement, to give preference over a person in
        relation to whom a certificate under section 267 is in force.".
