INDUSTRIAL RELATIONS REFORM ACT 1993 No. 98 of 1993 - SECT 33

Certain offences in relation to members of organisations etc.
33. Section 334 of the Principal Act is amended:

   (a)  by inserting after each of paragraphs (1)(ba) and (2)(ba) the
        following paragraphs:

"(bb) has refused or failed to agree or consent to, or vote in favour of, the
making of an agreement to which an organisation of which the employee is a
member would be a party;

   (bc) has refused or failed to become a party to, or otherwise agree or
        consent to the making of, or vote in favour of the making of, an
        agreement in respect of which the employer might apply to the
        Commission under Division 3 of Part VIB;";

   (b)  by inserting after paragraph (3)(ba) the following paragraphs:

"(bb) with intent to coerce the employee to agree or consent to, or vote in
favour of, the making of an agreement to which an organisation of which the
employee is a member would be a party;

   (bc) because the employee has refused or failed so to agree, consent or
        vote;

   (bd) with intent to coerce the employee to become a party to, or otherwise
        agree or consent to the making of, or vote in favour of the making of,
        an agreement in respect of which the employer might apply to the
        Commission under Division 3 of Part VIB;

   (be) because the employee has refused or failed so to become a party,
        agree, consent or vote;";

   (c)  by inserting after subsection (3) the following subsection:

"(3A) An employer must not (whether by threats or promises or otherwise)
induce an employee to stop being an officer, delegate or member of an
organisation, or of an association that has applied to be registered as an
organisation.".
