LAW AND JUSTICE LEGISLATION AMENDMENT (APPLICATION OF CRIMINAL CODE) ACT 2001 NO. 24, 2001 - SCHEDULE 37

1 After section 8
Insert: 8A Application of the Criminal Code
(1)
Subject to subsection (2), Chapter 2 of the Criminal Code applies to
all offences against this Act.
- Note: Chapter 2 of the Criminal Code
sets out the general principles of criminal responsibility.
(2) Part 2.5 of the Criminal Code does not apply to an offence against
Part 11 of this Act.
2 Section 171
Omit ", without reasonable
excuse".
3 At the end of section 171
Add:
(2) Subsection (1) does
not apply if the person has a reasonable excuse.
- Note: A defendant bears an
evidential burden in relation to the matter in subsection (2) (see
subsection 13.3(3) of the Criminal Code ).
(3) Subsection (1) is an offence of strict liability.
- Note: For strict
liability , see section 6.1 of the Criminal Code .
4 Section 172
Omit ", without reasonable excuse".
5 At the end of
section 172
Add:
(2) Subsection (1) does not apply if the person
has a reasonable excuse.
- Note: A defendant bears an evidential burden in
relation to the matter in subsection (2) (see subsection 13.3(3) of the
Criminal Code ).
6 Section 173
Omit "knowingly give evidence that is false or
misleading", substitute "intentionally give evidence that the person knows is
false or misleading".
7 Section 174
Omit ", without reasonable
excuse,".
8 At the end of section 174
Add:
(2) Subsection (1)
does not apply if the person has a reasonable excuse.
- Note: A defendant
bears an evidential burden in relation to the matter in subsection (2)
(see subsection 13.3(3) of the Criminal Code ).
9 Section 175
Repeal the section.
10 At the end of section 176
Add:
(2) Subsection (1) is an offence of strict liability.
- Note: For
strict liability , see section 6.1 of the Criminal Code .
11 Subsection 203DG(4)
Omit ", without reasonable excuse,".
12 After
subsection 203DG(4)
Insert:
Reasonable excuse for non-compliance
(4A)
Subsection (4) does not apply if the person has a reasonable excuse.

13 Subsection 203DG(5)
Omit "subsection (4)", substitute
"subsection (4A)".
- Note: The heading to subsection 203DG(7) is altered
by omitting " Knowingly making " and substituting " Making ".
