NAVIGATION AMENDMENT ACT 1980 No. 87, 1980 - SECT 30

30. (1) Section 61 of the Principal Act is amended by omitting ", not being a
river and bay ship,".

(2) Section 61 of the Principal Act is amended-

(a) by inserting "serving under articles of agreement" after "seaman" (first
occurring);

(b) by inserting in paragraph (a) "at a port" after "a superintendent"; and

   (c)  by adding at the end thereof the following sub-section:



"(2) When a contract of sea service with a seaman is terminated or otherwise
ceases to be in force and the seaman is in Australia, the employer, or a
person acting on behalf of the employer, shall-

   (a)  sign and give to the seaman, through or in the presence of a
        superintendent at a port, a discharge in accordance with the
        prescribed form or in a form approved by the Minister by instrument in
        writing; and

   (b)  return to the seaman any previous discharge of the seaman in the
        possession, custody or control of the employer.".
