1 At the end of section 84B
Add:
(5) For the purposes of the definition of spouse in subsection (4):
(a) a person who is legally married to another person (the person's partner ) is not taken to be living separately and apart from the person's partner on a permanent basis, if the person is living apart from the person's partner only because of the illness or infirmity of either or both of them; and
(b) a person is not taken to have ceased to live with another person (the person's partner ) on a de facto basis, if the person is living apart from the person's partner only because of the illness or infirmity of either or both of them.
2 Paragraph 87(2)(c)
After "family", insert "(within the meaning of Division 1A)".
3 Application
The amendments made by this Schedule apply in relation to relevant entitlement periods beginning on or after 1 January 2009.
