NATIONAL PARKS AND WILDLIFE CONSERVATION ACT 1975 No. 12, 1975 - SECT 18
Aboriginal land.
18. (1) Subject to sub-section (2), the Director may assist and co-operate
with Aboriginals in managing land to which this section applies for the
purpose of the protection and conservation of wildlife in that land and the
protection of the natural features of that land.
(2) The Director shall not take any action under sub-section (1) in relation
to any land except-
(a) after consultation with the Aboriginals, if any, as to whom the
Minister is satisfied that they have traditional rights in relation to
the land; and
(b) in accordance with an agreement between the Director and-
(i) in the case of land vested in Australia-the Minister of State
for Aboriginal Affairs;
(ii) in the case of land vested in a State-the Minister of that
State or the authority of that State, as the case may be,
having responsibility for the administration of that land; or
(iii) in the case of any other land-the person in whom, or body in
which, the land is vested.
(3) With the consent of the person with whom, or the party or body with which,
such an agreement is made by the Director in relation to any land, the
Governor-General may, by Proclamation, assign a name to that land.
(4) This section applies to-
(a) land vested in an Aboriginal or Aboriginals or in a body corporate
that is wholly owned by Aboriginals;
(b) land held upon trust for the benefit of Aboriginals; or
(c) any other land occupied by Aboriginals.
