PRIVACY ACT 1988 No. 119, 1988 - SECT 42

42. Where a complaint has been made to the Commissioner, the Commissioner may,
for the purpose of determining:

   (a)  whether the Commissioner has power to investigate the matter to which
        the complaint relates; or

   (b)  whether the Commissioner may, in his or her discretion, decide not to
        investigate the matter; make inquiries of the respondent.
