PATENTS AMENDMENT ACT 1989 No. 96, 1989 - SECT 8

Interpretation
8. (1) For the purposes of this Part, proceedings for the extension of the
term of a patent under Part IX of the Principal Act shall be taken to have
been commenced if the patentee has given to the Commissioner a request that
the Commissioner advertise in the Official Journal the patentee's intention to
take action in accordance with subsection 90 (1) or 95 (1) of the Principal
Act.

(2) Where a patentee has advertised the patentee's intention to take action in
accordance with subsection 90 (1) or 95 (1) of the Principal Act but has not
taken any action in a court in relation to the extension, the patentee may
discontinue those proceedings by advertising in the Official Journal the
patentee's intention to do so.
