PLANT BREEDER'S RIGHTS ACT 1994 No. 110, 1994 - SECT 18

Other acts that do not infringe PBR
18.(1) Despite the fact that a plant variety is covered by PBR, any act
referred to in section 11:

   (a)  that is done in relation to the propagating material of plants of that
        variety; and

   (b)  that enables the use of that propagating material:

        (i)    as a food, food ingredient or fuel; or

        (ii)   for any other purpose that does not involve the production or
               reproduction of the propagating material; does not infringe the
               PBR.

(2) Without limiting the generality of subsection (1), for the purpose of that
subsection, the use of propagating material of a plant by way of allowing it
to sprout and then eating it, or using it in the preparation of food, before
it has developed further, is not taken to be a use that involves the
production or reproduction of propagating material.
