PROCEEDS OF CRIME ACT 1987 No. 87, 1987 - SECT 84

Prosecution of offences
84. (1) An offence against section 52, 68, 73, 75, 81, 82, 83 or 97 is an
indictable offence.

(2) Notwithstanding that the offences referred to in subsection (1) are
indictable offences, a court of summary jurisdiction may hear and determine
proceedings in respect of an offence against section 52, 68, 73, 75, 82 or 97
if the court is satisfied that it is appropriate to do so and the defendant
and prosecutor consent.

(3) Where, in accordance with subsection (2), a court of summary jurisdiction
convicts a person of an offence referred to in that subsection, the penalty
that the court may impose is:

   (a)  if the offence is against section 73-a fine not exceeding $10,000; or

   (b)  if the offence is against section 52, 68, 75, 82 or 97:

        (i)    if the offender is a natural person-a fine not exceeding $2,000
               or imprisonment for a period not exceeding 12 months, or both;
               or

        (ii)   if the offender is a body corporate-a fine not exceeding
               $10,000.
