PROCEEDS OF CRIME ACT 2002 No. 85, 2002 - SECT 333

Meaning of conviction day

(1) For the purposes of this Act, the conviction day , in relation to a person's conviction of an * indictable offence, is:

(a)
if the person is taken to have been convicted of the offence because of paragraph 331(1)(a)—the day on which the person was convicted of the offence; or

(b)
if the person is taken to have been convicted of the offence because of paragraph 331(1)(b)—the day on which the person was discharged without conviction; or

(c)
if the person is taken to have been convicted of the offence because of paragraph 331(1)(c)—the day on which the court took the offence into account in passing sentence for the other offence referred to in that paragraph; or

(d)
if the person is taken to have been convicted of the offence because of paragraph 331(1)(d)—the day on which the person is taken to have * absconded in connection with the offence.

(2) For the purposes of paragraph (1)(a), the day on which the person was convicted of the offence is taken to be the first day on which the court acted on the finding that the offence was proved against the person (whether or not the court passed sentence on that day in relation to the offence).
