PROCEEDS OF CRIME ACT 2002 No. 85, 2002 - SECT 91

Simplified outline of this Part

If a person is convicted of a serious offence, property that is subject to a restraining order relating to the offence is forfeited to the Commonwealth unless the property is excluded from forfeiture. There are cases in which forfeited property can be recovered from the Commonwealth.

Note: Property can be forfeited in relation to a serious offence, without a conviction, under a forfeiture order under Part 2-2.
