SUPERANNUATION ACT 1976 No. 31, 1976 - SECT 140

Person who is entitled to rights under Division not entitled to rights under other provisions of Act.
140. (1) Subject to paragraph 139 (6) (b), where section 138 or 139 applies in
relation to a person, any benefit that, but for this Division, would be
payable to or in respect of the person under this Act upon him ceasing to be
an eligible employee, before attaining the age of 65 years, otherwise than by
reason of retirement on the ground of invalidity or death is not payable
except where that benefit is payable by virtue of the operation of this
Division.

(2) Where-

   (a)  lump sum benefit has been paid under section 80 to a person who has
        ceased to be an eligible employee; and

   (b)  after the lump sum benefit was paid, the person makes an election
        under section 137, the election does not have any effect unless an
        amount equal to the lump sum benefit is paid to the Commissioner
        within 7 days after the date of the election or within such further
        period as the Commissioner in special circumstances allows.
