SUPERANNUATION ACT 1976 No. 31, 1976 - SECT 146

146. (1) Subject to sub-section (2), section 112 applies in relation to a
payment of a transfer value under section 138 in respect of a person who has
been an eligible employee as if that payment were a payment of benefit under
this Act.

(2) Where-

   (a)  an amount has been paid by the Commissioner into the Superannuation
        Fund under paragraph 128 (2) (a) in respect of a person; and

   (b)  a benefit is subsequently paid under this Act to or in respect of the
        person, being a benefit consisting of-

        (i)    an instalment of pension (including pension constituting or
               forming part of any deferred benefits referred to in
               section 139);

        (ii)   a lump sum benefit payable under section 80 (including a lump
               sum benefit constituting a deferred benefit referred to in
               section 139); or

        (iii)  a transfer value referred to in section 138, section 112 and
               sub-section (1) of this section do not apply in relation to the
               payment of that benefit but there shall be paid out of the
               Superannuation Fund into the Consolidated Revenue Fund an
               amount equal to so much of the amount of that benefit as the
               Commissioner determines.
