SEAFARERS REHABILITATION AND COMPENSATION ACT 1992 No. 234, 1992 - SECT 71

Bankruptcy etc. of actual employer
71.(1) If:

   (a)  a claim in respect of an injury to an employee or in respect of the
        loss of, or damage to, property used by the employee, has been made
        under section  63 ; and

   (b)  the Fund has become the employer of the employee because of
        subsection  4(3) ; then:

   (c)  the claimant must give the Fund:

        (i)    a copy of any notices given to the actual employer in respect
               of the claim; or

        (ii)   new notices in respect of the claim; and

   (d)  section 72 or 73 applies as if the claim was given to the Fund on the
        day when:

        (i)    the copy of the claim was given to the Fund under subparagraph
               (1)(c)(i); or

        (ii)   a new claim notice was given to the Fund under subparagraph
               (1)(c)(ii).

(2) If:

   (a)  paragraph (1)(b) applies; and

   (b)  the actual employer has given a notice to the claimant under
        section 67; and

   (c)  the claimant has not given the information to the actual employer;
        then the claimant must give the information to the Fund.
