SOCIAL SECURITY (ADMINISTRATION) ACT 1999 - SECT 75
Secretary's power to request tax file numbers
- (1)
- This section applies to a person in Australia who:
- (a)
- has made a claim for a social security payment; or
- (b)
- is receiving a social security payment.
- (2)
- The Secretary may request, but not compel, a person to whom this section
applies:
- (a)
- if the person has a tax file numberto give the Secretary a written
statement of the person's tax file number; or
- (b)
- if the person does not have a tax file number:
- (i)
- to apply to the Commissioner of Taxation for a tax file number; and
- (ii)
- to give the Secretary a written statement of the person's tax file number
after the Commissioner of Taxation has issued it.
- (3)
- If:
- (a)
- this section applies to a person; and
- (b)
- the person is a member of a couple; and
- (c)
- the person's partner is in Australia;
the Secretary may request, but not compel, the person to give the Secretary a
written statement of the tax file number of the person's partner.
- (4)
- If:
- (a)
- this section applies to a person (the recipient ) because the person is
receiving a social security payment; and
- (b)
- the income of a person (other than the recipient) is required to be taken
into account for the purpose of working out the rate of the recipient's social
security payment; and
- (c)
- the person referred to in paragraph (b) is in Australia;
the Secretary may request, but not compel, the recipient to give the Secretary
a written statement of the tax file number or numbers of each person who is a
person referred to in paragraph (b).
