SOCIAL SECURITY LEGISLATION AMENDMENT ACT (No. 2) 1994 No. 109, 1994 - SECT 42

42. Section 17 of the Principal Act is amended:

   (a)  by omitting from paragraph (2)(d) ", other than a payment to which the
        recipient has contributed";

   (b)  by inserting after subsection (2) the following subsection:



"(2A) Paragraph (2)(d) does not apply to a compensation payment if:

   (a)  the recipient has made contributions (for example, by way of insurance
        premiums) towards the payment; and

   (b)  the agreement under which the contributions are made does not provide
        for the amounts that would otherwise be payable under the agreement
        being reduced or not payable because the recipient is eligible for or
        receives payments under this Act that are compensation affected
        payments.".
