SOCIAL SECURITY LEGISLATION AMENDMENT ACT (No. 2) 1994 No. 109, 1994 - SECT 44

44. Section 912 of the Principal Act is repealed and the following sections
are substituted: Home child care allowance not payable to more than one person
for same child

"912. If:

   (a)  more than one person qualifies for home child care allowance in
        relation to the same child; and

   (b)  the Secretary has not made a declaration under subsection 938(1) in
        respect of home child care allowance in relation to the child; and

   (c)  one of the persons is receiving home child care allowance for the
        child; home child care allowance is not payable to any other person in
        relation to that child. Note: Subsection 938(1) allows the Secretary
        to make a declaration that more than one person can share home child
        care allowance.

Home child care allowance not payable to more than one member of a couple

"912A. If:

   (a)  both members of a couple are qualified for home child care allowance;
        and

   (b)  one of the members of the couple is receiving home child care
        allowance; home child care allowance is not payable to the other
        member of the couple.".
