TELECOMMUNICATIONS ACT 1975 No. 55 of 1975 - SECT 20
Commission to do as little damage as possible and to pay compensation.
20. (1) In the exercise of a power conferred upon the Commission under this
Act, the Commission, an officer or employee of the Commission, a person acting
for or on behalf of the Commission under a contract or the employee of such a
person shall cause as little detriment and inconvenience and do as little
damage as possible.
(2) Where the owner of land is injuriously affected by the exercise, in
relation to that land, of any of the powers conferred by this Part,
compensation shall be paid by the Commission.
(3) Where land is entered or occupied in pursuance of this Part, the
Commission is liable to pay compensation to the owner or occupier of the land,
or both, as the case requires, and the compensation so payable shall include
compensation in respect of damage of a temporary character as well as damage
of a permanent character.
(4) Nothing in this section shall be construed as excluding or limiting any
liability of the Commission apart from this section in respect of a matter in
relation to which compensation is not payable under this section.
(5) The amount of compensation payable to a person under this section shall be
determined by agreement between the person and the Commission and in the
absence of agreement shall be determined by arbitration in accordance with the
law of the State or Territory in which the claim arises relating to the
settlement of commercial disputes by arbitration.
