TELECOMMUNICATIONS (CONSUMER PROTECTION AND SERVICE STANDARDS) ACT 1999 - SECT 89
Repayment of excess advances
(1) If:
(a) a person has received a total amount, by way of advances on
account of payments that may become payable to the person under section 85 in
relation to a particular financial year; and
(b) that total amount is greater than the amount that became payable to
the person under section 85 in relation to that financial year;
the
person is liable to pay to the Commonwealth the amount of the excess.
(2) If a person is liable to pay an amount to the Commonwealth under
subsection (1):
(a) the amount may be recovered, as a debt due to the
Commonwealth, by action in a court of competent jurisdiction; or
(b) the amount may be deducted from any other amount that is payable to
the person under this Part, and if the amount is so deducted, the
other amount is taken to have been paid in full to the person.
