TRANSPORT SAFETY INVESTIGATION ACT 2003 No. 18, 2003 - SECT 31
Powers conferred on magistrates
- (1)
- A power conferred on a magistrate by this Part is conferred on the
magistrate in a personal capacity and not as a court or a member of a court.
The magistrate need not accept the power conferred.
- (2)
- A magistrate exercising such a power has the same protection and immunity
as if the magistrate were exercising that power as, or as a member of, the
court of which the magistrate is a member.
- (3)
- A warrant under this Part in respect of premises in a State or Territory
may be issued by a magistrate of another State or Territory. This subsection
is enacted to avoid doubt.
