- (1)
- This section applies if a maximum penalty is specified at the foot of a
provision of this Act, being a provision that is either:
- (a)
- a section of this Act that is not divided into subsections; or
- (b)
- a subsection of a section of this Act.
- (2)
- If the provision is expressed to create an offence, then the offence is
punishable, on conviction, by a penalty up to the maximum specified.
- (3)
- If the provision is not expressed to create an offence, then a person who
contravenes the provision is guilty of an offence against the provision that
is punishable, on conviction, by a penalty up to the maximum specified.
