WHEAT MARKETING ACT 1984 NO. 141 OF 1984 - SECT 4
Australian Wheat Board
4. (1) The Australian Wheat Board that was, immediately before the
commencement of this Act, in existence by virtue of the Wheat Marketing Act
1979 is continued in existence.
(2) The Board is a body corporate with perpetual succession and a common seal,
and may acquire, hold and dispose of real and personal property and is capable
of suing and being sued in its corporate name.
(3) All courts, judges and persons acting judicially-
(a) shall take judicial notice of the imprint of the common seal of the
Board appearing on a document and shall presume that the document was
duly sealed; and
(b) shall take judicial notice of the signature of a person who is or has
been the Chairperson and of the fact that the person is or was the
Chairperson.
(4) The exercise or performance of a power or function by the Board is not
invalidated by reason only of a vacancy or vacancies in the membership of the
Board.
(5) A notice, authority, communication or instrument given or made by the
Board is sufficiently authenticated if signed by the Chairperson on behalf of
the Board, and a notice, authority, communication or instrument so signed
shall, in the absence of proof to the contrary, be deemed to have been given
or made with the authority of the Board.
