WHEAT MARKETING AMENDMENT ACT 1986 No. 82 of 1986 - SECT 45

45. Section 5 of the Principal Act is amended-
(a) by omitting "Where" and substituting "Subject to sub-section (2), where";

   (b)  by omitting ", on application in writing made to the Board,"; and

   (c)  by adding at the end the following sub-section:

"(2) Where the Board is unable to make a refund to a person as mentioned in
sub-section (1), the Board shall pay the amount of the refund to the
Commonwealth.".
