WHEAT MARKETING AMENDMENT ACT 1986 No. 82 of 1986 - SECT 9

9. Section 11 of the Principal Act is amended-
(a) by omitting "The Minister" and substituting "Subject to sub-section (2),
the Minister"; and

   (b)  by adding at the end the following sub-sections:

"(2) The Minister shall not give a direction to the Board under sub-section
(1) unless-

   (a)  the Minister is satisfied that, by reason of the existence of
        exceptional circumstances, it is necessary to give the direction to
        the Board in order to ensure that the performance of the functions, or
        the exercise of the powers, of the Board does not conflict with major
        government policies;

   (b)  the Minister has given to the Board a notice in writing stating that
        the Minister is considering giving the direction; and

   (c)  the Minister has given to the Chairperson an adequate opportunity to
        discuss with the Minister the need for the proposed direction.

"(3) Where the Minister gives a direction to the Board under sub-section (1)-

   (a)  the Minister shall cause a notice in writing setting out particulars
        of the direction to be published in the Gazette as soon as practicable
        after giving the direction; and

   (b)  the Minister shall cause a copy of that notice to be laid before each
        House of the Parliament within 15 sitting days of that House after the
        publication of the notice in the Gazette.".
