WHALE PROTECTION ACT 1980 No. 92 of 1980 - SECT 37

Regulations
37. (1) The Governor-General may make regulations, not inconsistent with
this Act, prescribing all matters required or permitted by this Act to be
prescribed or necessary or convenient to be prescribed for carrying out or
giving effect to this Act or an agreement between Australia and another
country or countries relating to whales.

(2) Without limiting the generality of sub-section (1), regulations may be
made-

   (a)  providing for functions and powers to be conferred, and duties to be
        imposed, upon inspectors;

   (b)  regulating in a Territory (other than the Northern Territory) trade
        and commerce in whales;

   (c)  providing for the transportation, treatment and disposal of whales
        taken in waters to which this Act applies or unlawfully imported;

   (d)  providing for the methods or equipment by which whales may be killed,
        taken or interfered with otherwise than in contravention of this Act;

   (e)  providing for the gathering and dissemination of information relating
        to whales; and

   (f)  providing for any matter incidental to or connected with any of the
        foregoing.

(3) The regulations may provide, in respect of an offence against the
regulations, for the imposition of-

   (a)  a fine not exceeding $2,000; or

   (b)  a fine not exceeding $200 for each day during which the offence
        continues.

(4) The limitation imposed by sub-section (3) on the penalties that may be
prescribed by the regulations does not prevent the regulations from requiring
a person to make a statutory declaration.
