(1) The Secretary may, by notice in writing, ask an operator to give the
Secretary, within 30 days of receiving the notice:
- (a)
- information about the
noise level of an aircraft; or
- (b)
- information relevant to determining whether, at the time an aircraft took
off or landed, it was involved in an emergency (within the meaning of
subregulation 14 (2)).
(2) A notice under subregulation (1) must state:
- (a)
- the information to be
provided; and
- (b)
- how the information is to be provided; and
- (c)
- that the operator must comply with the notice within 30 days of
receiving the notice.
(3) An operator is guilty of an offence if:
- (a)
- the operator fails to comply
with a notice under subregulation (1); and
- (b)
- the notice has been issued under subregulation (1).
Penalty:
10 penalty units.

- Strict liability applies to the element of an
offence under subregulation
- (3)
- mentioned in paragraph (3) (b).
- (5)
- Subregulation (3) does not affect a person's right to refuse to give
information on the ground that the information, or giving the information,
might tend to incriminate the person or expose the person to a penalty.
