1989 No. 354 AIR NAVIGATION (AERODROME CURFEW) REGULATIONS - REG 8

Classification of aircraft
8.(1) Where the operator of an aircraft indicates, in a flight plan in respect
of that aircraft, that he or she intends that that aircraft land at, or take
off from, the Aerodrome during a curfew period, then:

   (a)  subject to subregulation (2), the operator must, upon request by the
        Secretary or an authorised person, supply the Secretary or an
        authorised person with sufficient information to establish whether or
        not that aircraft is an aircraft that complies with the relevant
        requirements in relation to noise levels specified in chapter 3, 5, 6
        or 10 of Part II of Volume I of the Annex in respect of its
        classification in that Part; and

   (b)  upon request by the Secretary or an authorised person, whether before
        or after the relevant flight of that aircraft, the operator must,
        within 7 days of his or her receipt of the request, supply the
        Secretary or an authorised person with information establishing, in
        respect of a particular flight, whether or not the aircraft is a
        jet-propelled aircraft that is being used for the carriage of
        passengers for hire or reward to or from the Aerodrome or an
        international aircraft. Penalty: $5,000.

(2) Unless the engine of the aircraft is subsequently modified, the operator
of an aircraft must not under paragraph (1)(a) be required to supply the
Secretary or an authorised person on more than one occasion with information
that he or she would otherwise, under that paragraph, be required so to
supply.
