1990 No. 443 AUSTUDY REGULATIONS - REG 42
Progress: (c) completed course of the same level 1
42. (1) A student cannot get AUSTUDY for a tertiary course in a year if:
(a) he or she has previously completed another course of the same level; 2
and
(b) he or she has not yet caught up to the point reached in the other
course, or to within half a full-time year's work of that point.
(2) Whether the student has caught up is measured by comparing the work
successfully completed in the present course against the work successfully
completed in the other course (including any credit received in either
course).
(3) Subregulation (1) does not apply if the institution where the student is
studying offers a combined course approved for the AUSTUDY scheme comprising
the student's present course and:
(a) the student's previous course; or
(b) a course of the same length and in the same field as the previous
course; (whether or not the student undertakes the previous and
present courses separately or as a combined course). 3 Notes to

academic year: see regulation 37. 2 Levels of courses are defined in
regulation 38. 3 Regulation 43 applies to combined courses.
