1990 No. 443 AUSTUDY REGULATIONS - REG 74

Independent student: (g) homelessness
74. (1) The student qualifies as independent through being homeless if he or
she does not live at the home of his or her parents because of domestic
violence, sexual harassment, serious family breakdown or other similar
exceptional circumstances.

(2) The student must not:

   (a)  get financial or other support from either of the student's natural or
        adoptive parents or be wholly or substantially dependent on someone
        else on a long-term basis; or

   (b)  be living in accommodation owned or rented by a natural or adoptive
        parent; or

   (c)  get any regular payment of welfare or student assistance from the
        Commonwealth, a State or a Territory (except for AUSTUDY); or

   (d)  have a de facto spouse who gets a regular payment from the
        Commonwealth, a State or a Territory at a higher rate because the
        student is his or her de facto spouse.
