1993 No. 367 AUSTUDY REGULATIONS (AMENDMENT) - REG 44

44.1 Subregulation 96 (1): Omit the subregulation, substitute:

"(1) If the circumstances described in subregulation (4) apply to a student,
for the purposes of the calculation of the income of the student's spouse in
regulation 94:

   (a)  the income of the student's spouse is taken to be the amount of that
        income in the financial year ending in the year of study; and

   (b)  the value of all fringe benefits received by the student's spouse is
        taken to be the total value of those benefits that exceeds $1,000,
        being fringe benefits that are:

        (i)    described in subregulation 94 (1C); and

        (ii)   received in the fringe benefits year ending in the year of
               study.".
