AUSTRALIAN RADIATION PROTECTION AND NUCLEAR SAFETY (LICENCE CHARGES) REGULATIONS 2000 2000 No. 307 - REG 6

Annual charge for source licence
(1)
For subsection 5 (2) of the Act, this regulation prescribes the amount of the charge for a financial year for a source licence that authorises persons to deal with a controlled apparatus or a controlled material of a kind mentioned in column 2 of an item in Group 1, 2 or 3 of Part 1 of Schedule 3.


(2) Subject to subregulation (3), the amount of the charge for the year for each licence held by a controlled person at any time during the year is:

AC ÷ NL

where:
AC is the amount mentioned in column 3 of the item in Part 2 of Schedule 3 that relates to the number of licences that:

(a)
are held by the controlled person during the year; and

(b) authorise persons to deal with controlled apparatus or controlled materials that:

(i)
are of a kind mentioned in the same Group of Part 1 of Schedule 3; and
(ii)
are in the same location.

NL is the number of licences that:

(a)
are held by the controlled person during the year; and

(b) authorise persons to deal with controlled apparatus or controlled materials that:

(i)
are of a kind mentioned in the same Group of Part 1 of Schedule 3; and
(ii)
are in the same location.

Examples
1
In a financial year, a controlled person holds 3 source licences that authorise persons to deal with controlled apparatus or controlled materials that are of a kind mentioned in Group 3 of Part 1 of Schedule 3 and that are in the same location. The annual charge for each licence is calculated using the formula set out above as follows:
Step 1
Identify AC , ie the relevant amount in Part 2 of Schedule 3. This is the amount mentioned in paragraph (c) of item 1 — $6 000.
Step 2
Divide this amount by NL , ie the number of relevant licences held by the controlled person — 3.
The amount of annual charge for the year for each of the 3 licences is therefore $2 000. The total amount of annual charge for the year for the 3 licences is $6 000.

In a financial year, a controlled person holds 8 source licences that authorise persons to deal with controlled apparatus or controlled materials that are of a kind mentioned in Group 2 of Part 1 of Schedule 3 and that are in the same location. The annual charge for each licence is calculated using the formula set out above as follows:
Step 1
Identify AC , ie the relevant amount in Part 2 of Schedule 3. This is the amount mentioned in paragraph (b) of item 2 — $4 000.
Step 2
Divide this amount by NL , ie the number of relevant licences held by the controlled person — 8.
The amount of annual charge for the year for each of the 8 licences is therefore $500. The total amount of annual charge for the year for the 8 licences is $4 000.

In a financial year, a controlled person holds 25 source licences that authorise persons to deal with controlled apparatus or controlled materials that are of a kind mentioned in Group 1 of Part 1 of Schedule 3 and that are in the same location. The annual charge for each licence is calculated using the formula set out above as follows:
Step 1
Identify AC , ie the relevant amount in Part 2 of Schedule 3. This is the amount mentioned in paragraph (a) of item 3 — $2 500.
Step 2
Divide this amount by NL , ie the number of relevant licences held by the controlled person — 25.
The amount of annual charge for the year for each of the 25 licences is therefore $100. The total amount of annual charge for the year for the 25 licences is $2 500.

Note
Same location is defined in subregulation 40D (3) of the ARPANS Regulations (see the Dictionary to those Regulations).

(3)
If the holder of the licence is a controlled person mentioned in column 2 of an item in Part 3 of Schedule 3, the amount of the charge for the year for all source licences held by that person for the year is the amount mentioned in that item.

Division 5 of Part 4 of the ARPANS Regulations makes provision in relation to the time for payment of the annual charge, pro-rating and refunds.
