For the definition of GBE in section 5 of the Act, the following authorities and companies are prescribed:

(a)

(e)

Bankstown Airport Limited;

(f)

5 Statutory marketing authorities (Act, s 5)

For the definition of SMA in section 5 of the Act, the following authorities are prescribed:

(a)

Australian Dairy Corporation;

(b)

Australian Wine and Brandy Corporation.

[4] After paragraph 7 (1) (f)

insert

(fa)

whether the company is:

(i)

a public company; or

(ii)

a large proprietary company; or

(iii)

a small proprietary company; or

(iv)

a company with only 1 member;

In this regulation, each of the following terms has the meaning given by section 9 of the Corporations Act 2001 :

(a)

company limited by guarantee;

(b)

company limited by shares;

(c)

foreign company;

(d)

large proprietary company;

(e)

no liability company;

(f)

small proprietary company;

(g)

ultimate holding company;

(h)

unlimited company.

In this regulation:

"public company" means a company that is not a proprietary company within the meaning of section 9 of the Corporations Act 2001 .
